Trust as an NGO Structure

A Public Charitable Trust is the most widely used NGO structure in India for organizing education, health, social welfare, and religious activities. Registered under the Indian Trusts Act, 1882 (or respective state act), it is governed by trustees appointed in the Trust Deed. It is simpler to manage than a Society (no regular elections) and more straightforward than a Section 8 Company. Once registered, the trust can obtain 12A and 80G tax exemptions, apply for FCRA to receive foreign donations, and access government grants.

How to Register a Charitable Trust

Trust registration is done at the Sub-Registrar office (for immovable property) or Notarized (for movable property only).

1Step 1: Draft Trust Deed

Prepare comprehensive Trust Deed specifying name, registered office, objectives, trustees, their powers, beneficiaries, and dissolution procedure.

2Step 2: Execute on Stamp Paper

Print on appropriate stamp paper (value varies by state). All trustees must sign in the presence of 2 witnesses.

3Step 3: Register at Sub-Registrar Office

Present before the Sub-Registrar along with trustees and witnesses for in-person registration.

4Step 4: Receive Registered Trust Deed

Sub-Registrar registers and returns the certified copy. Trust is legally constituted.

5Step 5: Apply for PAN and Bank Account

Apply for PAN for the Trust. Open a bank account in the Trust name.

Trust registration takes 15–20 days. All trustees must be present at the Sub-Registrar office — the key step.
